Just because an insurance policy claims it can cover your day care business doesn't mean it will. Not all day care policies are created equal. In fact, many of them fail to offer basic liability coverage. What should you look for in a liability policy for your day care business?

Accidental Medical Insurance – This will cover medical bills resulting from an accident, regardless of fault. Be sure there is no deductible.

Alienation of Affection – This protects you against claims of "stealing the affection and control" of a child from their parent or legal guardian.

Child Abuse – This covers claims made against you, residents of your household, or your employees – regardless of whether or not the charges are groundless. Beware of policies that include child abuse defense costs in the limit as it could hamper your coverage needs.

Contractual Liability – This protects your obligations regarding written agreements. It could cover your obligations to seek medical care in emergencies, take a child on field trips, or release the child after school.

Defense Coverage – If you are sued, will the insurance company pay for your defense even if the suit (claim) is groundless or fraudulent? Look for a policy whose legal defense coverage is specifically stated.

Field Trips / Off Premised Activities – This provides coverage when you are away from your premises: trips to the park, museum, theater or market.

Incidental Malpractice – This covers your liability should you or a staff member accidentally give the wrong medication or dietary supplement to a child.

Personal Injury – This protects you against libel, slander, false arrest, wrongful eviction and malicious prosecution.

Products Liability – This includes preparing and serving of food.

Non-owned Auto Liability – This provides protection from lawsuits resulting from children getting injured in an automobile accident caused by someone using their car on your behalf. This coverage is not part of the liability coverage and may be offered as an option.

Transportation Coverage – This protects you from lawsuits resulting from children injured in an automobile operated by you or one of your employees. This coverage is not part of the liability coverage and may be offered at an additional cost.
